OU to provide Francis with nearly un-redacted report

Judge Martha D. Anderson has ruled that Oakland University must provide former women’s basketball coach Beckie Francis a copy of a nearly un-redacted version of the internal investigation report that led to her firing, according to an article in The Detroit Free Press.

Francis has received copies of the report in the past, but according to her attorney, Deborah Gordon, the copies were “virtually 100 percent redacted.”

Francis sued the school for the document, and on Wednesday, Nov. 13, it was decided that OU would turn over the document and await response from the judge.

According to The Free Press, Anderson wrote in her ruling: “There can be no dispute the report qualifies as part of Francis’ personnel record. This is an internal report ‘kept by the employer that identifies the employee, to the extent that the record is used or has been used, or may affect or be used relative to that employee’s qualifications for employment or disciplinary action.’ The report was unquestionably used in the decision-making process relative to Francis’ termination. The university provides several reasons for its near complete redaction of the report — some of which do not apply and others are based on an overly-broad interpretation of the act.”
